If you have been injured in an accident involving another driver’s failure to obey a traffic signal, you may file a personal injury claim against them to seek compensation for your damages. There are four elements that you must prove in a personal injury case based on an accident caused by a traffic signal violation: duty, breach, causation, and damages. Regarding duty, the law requires all motorists to use the same level of reasonable care and skill that a prudent driver would use when faced with the same situation. This standard encompasses many different things, including weather conditions, traffic, roadway hazards, and applicable traffic laws. According to Florida Statutes section 316.123, all drivers are required to yield at a controlled stop. Violating laws involving texting or talking on the phone while driving, or driving under the influence, are other examples of statutory violations.
To establish a breach, the plaintiff must show that the defendant failed to operate their motor vehicle according to the duty of care. If a driver ran a red light, this will be strong evidence that they breached the duty and that this was an accident caused by a traffic signal violation.
After establishing that the defendant owed a duty of care and failed to act accordingly, the plaintiff must next show that there is a causal link between the breach and the damages that they suffered. If the defendant claims that the plaintiff was comparatively negligent, meaning that they were also partly at fault, the jury will be allowed to assign a percentage of fault to the plaintiff’s negligence. If the jury awards the plaintiff damages, the award will then be reduced by this percentage. A compensation award will account for both economic and non-economic damages, including medical payments, missed wages, pain and suffering, vehicle repairs, and diminished quality of life.
